1. Contest Period: The Name the Comforts Firefly Contest (“Contest”) begins at 12:00:01 a.m. Eastern Time (“ET”) on June 1, 2009 and ends at 11:59:59 p.m. ET on July 31, 2009 (the “Contest Period”)

2. How To Enter: During the Contest Period, you may enter the Contest online by visiting www.comfortsbaby.com (“Contest Web Site”), following the online entry instructions and including responses to the survey questions. You must include all information requested on the online entry form, including the original name you created for the Comforts firefly, in 25 characters or less (“Entry”). The Entry must: 1) be complete to be eligible; 2) be in English. Any Entry deemed inappropriate or unsuitable, in Sponsor’s sole discretion will be disqualified. Any Entry that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entrant. Entrants may not copy or otherwise plagiarize the Entry from any source. All Entries submitted become the property of the Sponsor and will not be returned. Normal Internet access and usage charges imposed by Entrants’ online service will apply. Limit one Entry per person. Duplicate submissions will automatically be disqualified. No information regarding Entries or judging, other than as otherwise set forth in the Official Rules will be disclosed. All Entries must be received by 11:59:59 p.m. ET July 31, 2009. All Entries become the property of Sponsor. Entries will not be returned and Sponsor will not acknowledge receipt of Entries.

3. Prize And Approximate Retail Value (“ARV”): Grand Prize (1): A $10,000 scholarship awarded as a College Savings Plan (529 Plan) for winner’s child (ARV $10,000). All taxes are the responsibility of the Grand Prize winner and he/she will be required to provide his/her social security number. Grand Prize winner is advised to consult with his/her accountants, lawyers or other financial advisers regarding specific tax implications. Prize is not transferable and no substitution is allowed. Sponsor reserves the right to substitute prize of equal or greater value.

4. Judging Criteria: All eligible Entries will be judged, to determine one Grand Prize winner based on the following criteria: Most Inventive (40%); Appropriateness to Campaign Theme (30%); Most Compelling (30%). Eligible Entries will be judged by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final on all matters relating to this Contest, on or about August 21, 2009. Decisions of judges are final on all matters relating to this Contest. In the event of a tie, tied entries will be re-judged based on Most Inventive. In the event that the winning Entry (or Entries) was submitted by more than one Entrant, a random drawing will be conducted from among all those Entries with the same name, to determine the Grand Prize winner, if applicable. Entries must be entrant’s own original idea, have not won a previous prize or award and have not been previously published.

5. Eligibility: Contest is only open to legal residents of the United States, including the District of Columbia, who are 18 years of age or older, and have a child under the age of 2 as of date of entry. Employees of Kroger, PBM Products, Don Jagoda Associates, Inc., and each of their respective affiliates, parent companies, subsidiaries, promotion partners, advertising and promotional agencies and the immediate families (including, but not limited to, spouses, parents, siblings, and children) or household members of each, are not eligible to enter or win. Void where prohibited or restricted by law. All Federal, state and local laws and regulations apply

6. General Rules: By participating in this Contest, each participant agrees that Sponsor may, at its option, conduct a background check on participant. Prize will be awarded, provided a sufficient number of eligible Entries are received. Potential Grand Prize winner will be notified by mail and/or email. The Grand Prize winner will be required to execute and return an Affidavit of Eligibility, Authenticity, Liability/Publicity Release (where legal) and Assignment of Rights within ten (10) days of notification attempt or the prize will be forfeited and an alternate winner judged. Return of prize notification as undeliverable may result in disqualification and alternate determination. No responsibility or liability is assumed by Sponsor and its agencies for damages, losses or injury resulting from acceptance or use of prize, including, but not limited to, participation in the Contest. The winning entrant acknowledges and agrees that his/her Entry and all related materials created in or arising out of the production of the concept shall be, effective upon creation, assigned to and become the property of Sponsor, which thereafter has the royalty-free, perpetual right to edit, re-edit, adapt, modify, reproduce, promote, distribute create derivative works and otherwise use the Grand Prize winning Entry in any way it sees fit. Acceptance of prize constitutes permission to use the winner’s name, Entry, biographical information and likeness without compensation, except where prohibited by law. By participating in this Contest, entrants and winner release Sponsor and its parents, affiliates, subsidiaries, officers, agents, employees, advertising agencies, and all others associated with the development and execution of the Contest, from and against any and all liability with respect to or in any way arising from the Contest and/or acceptance or use of prize, including, without limitation, liability for personal injury, damages or loss. Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of Entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest or Contest Web Site; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor and its agencies are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Contest which may limit the ability to participate or by any human error which may occur in the processing of the Entries in this Contest. Sponsor reserves the right to cancel the Contest if it becomes technically corrupted, and award prizes from eligible Entries received prior to cancellation. Entrants agree to be bound by these Official Rules and the decisions of the judges.
